The collection of this data is carried out on the one hand by the information you actively provide, for example in the contact form, and on the other hand automatically by our IT systems, which primarily record technical information on the operating system or the browser. This data is collected automatically when you visit invensity.com. 2. General notes and mandatory information

2.1 Data protection

The operators of invensity.com take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the legal data protection regulations and this data protection declaration. The use of invensity.com is usually possible without providing personal data.

As far as personal data (e.g. name, address or e-mail addresses) is collected on our pages, this is always done on a voluntary basis as far as possible. This data will not be passed on to third parties without your express consent. We would like to point out that data transmission on the Internet (e.g. communication by e-mail) can have security gaps. A complete protection of data against access by third parties is not possible.

2.3 Revocation, information and complaint

You have the right to receive information about your personal data stored with us at any time. You also have the right to correct, block or, apart from the prescribed data storage for business purposes, delete your personal data.

In order to be able to take into account a blocking of data at any time, these data must be kept in a blocking file for control purposes. You can also demand the deletion of the data, as long as there is no legal archiving obligation. If such an obligation exists, we will block your data upon request. You can make changes or withdraw your consent by notifying us accordingly with effect for the future.

2.4 SSL or TSL encryption

This site uses SSL or TSL encryption for security reasons and to protect the transmission of confidential content, such as the requests you send to us as site operator. You can recognise an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line. If the SSL encryption is activated, the data that you transmit to us cannot be read by third parties.

2.5 Objection to advertising e-mails

The use of contact data published within the scope of the imprint obligation for the transmission of not expressly requested advertising and information material is hereby contradicted. The operators of invensity.com expressly reserve the right to take legal action in the event of unsolicited sending of advertising information, for example through spam e-mails.

3. Data collection on this website

3.1 Cookies

The websites of invensity.com partly use so-called cookies. Cookies do not damage your computer and do not contain viruses. Cookies serve to make our offer more user-friendly, more effective and safer. Cookies are small text files that are stored on your computer and saved by your browser. Most of the cookies we use are so-called “session cookies”. They are automatically deleted at the end of your visit. Other cookies remain stored on your terminal device until you delete them. These cookies enable us to recognize your browser on your next visit. You can set your browser so that you are informed about the setting of cookies and allow cookies only in individual cases, exclude the acceptance of cookies for certain cases or in general and activate the automatic deletion of cookies when closing the browser. 3.2 Server-Log Files

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • Referrer URL
  • Host name of the accessing computer
  • Time of the server request

These data cannot be assigned to specific persons. This data is not merged with other data sources. We reserve the right to subsequently check this data if we become aware of concrete indications of illegal use.

3.3 Contact form

If you send us enquiries via the contact form, your details from the enquiry form, including the contact data you provide there, will be stored by us for the purpose of processing the enquiry and in the event of follow-up questions. We will not pass on this data without your consent.

3.4 Google Analytics

The person responsible for processing has integrated the Google Analytics component (with anonymisation function) on this website. Google Analytics is a web analysis service. Web analysis is the collection, collection and evaluation of data on the behaviour of visitors to websites. Among other things, a web analysis service collects data about the website from which a data subject has accessed a website (so-called referrer), which sub-pages of the website have been accessed or how often and for how long a subpage has been viewed. The data controller uses the addition “_gat._anonymizeIp” for web analysis via Google Analytics. By means of this addition, the IP address of the Internet connection of the person concerned is shortened and anonymised by Google if the access to our Internet pages is from a member state of the European Union or from another state that is a party to the Agreement on the European Economic Area. Your IP address is recorded, but immediately (e.g. by deleting the last 8 bits) pseudonymised. Thus only a rough localization is possible.

The purpose of the Google Analytics component is the analysis of visitor flows on our website. Google uses the data and information obtained, among other things, to evaluate the use of our website, to compile online reports for us which show the activities on our website, and to provide further services in connection with the use of our website.

Google Analytics places a cookie on the information technology system of the person concerned. What cookies are has already been explained above. By setting the cookie, Google is able to analyse the use of our website. Each time one of the individual pages of this website, which is operated by the data controller and on which a Google Analytics component has been integrated, is called up, the Internet browser on the information technology system of the person concerned is automatically prompted by the respective Google Analytics component to transmit data to Google for the purpose of online analysis.

As part of this technical process, Google obtains knowledge of personal data, such as the IP address of the person concerned, which Google uses, among other things, to trace the origin of visitors and clicks and subsequently to enable commission settlements. The collection of IP addresses at invensity.com is anonymous, as mentioned above. The cookie is used to store personal information, such as the time of access, the location from which an access originated and the frequency of visits to our website by the person concerned. Whenever you visit our website, this personal data, including the IP address of the Internet connection used by the person concerned, is transmitted to Google in the United States of America. This personal data is stored by Google in the United States of America.

Google may pass on this personal data collected via the technical process to third parties. The person concerned can prevent the setting of cookies by our website, as already described above, at any time by means of a corresponding setting in the Internet browser used and thus permanently object to the setting of cookies. Such a setting of the Internet browser used would also prevent Google from placing a cookie on the information technology system of the person concerned.

In addition, a cookie already set by Google Analytics can be deleted at any time via the Internet browser or other software programs. Furthermore, the data subject has the opportunity to object to and prevent the collection of data generated by Google Analytics and relating to the use of this website and the processing of this data by Google. To do this, the person concerned must download and install a browser add-on from the link https://tools.google.com/dlpage/gaoptout?hl=en.

This browser add-on informs Google Analytics via JavaScript that no data and information about visits to websites may be transmitted to Google Analytics. The installation of the browser add-on is considered by Google as a contradiction. If the data subject’s information technology system is deleted, formatted or reinstalled at a later date, the data subject must reinstall the browser add-on in order to deactivate Google Analytics.

If the Browser Add-On is uninstalled or deactivated by the person concerned or another person within their sphere of control, there is the possibility of reinstalling or reactivating the Browser Add-On. Invensity.com only use Google Analytics with activated IP anonymization. This means that the IP address of users is shortened by Google within member states of the European Union or in other states which are parties to the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transferred to a Google server in the USA and shortened there. The IP address transmitted by the user’s browser is not merged with other data from Google.

3.5 Google Maps

The internet presence of the INVENSITY GmbH uses Google Maps to display a site plan. Google Maps is operated by Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. By using this website, you consent to the collection, processing and use of the automatically collected data as well as the data entered by you by Google, one of its representatives or third parties.

3.6 Google Fonts

The use of fonts via Google Fonts is in the interest of a uniform and appealing presentation of the online offers of invensity.com. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f DSGVO.

3.7 Google reCAPTCHA

We use Google reCAPTCHA on our website to check and prevent interactions on our website by automated access, e.g. by so-called bots. This is a service of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, hereinafter referred to as “Google”.

Due to the certification according to the EU-US Privacy Shield (“EU-US Privacy Shield”) Google guarantees that the data protection requirements of the EU are also complied with when processing data in the USA.

Through this service, Google can determine from which website a request is sent as well as from which IP address you use the so-called reCAPTCHA input box. In addition to your IP address, other information may be collected by Google that is necessary for the offer and guarantee of this service.

The legal basis is Art. 6 para. 1 lit. f) DSGVO. Our legitimate interest lies in the security of our website and in the defense against unwanted, automated access in the form of spam or similar.

3.8 Browser Plugin

You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of invensity.com. 3.9 Storage period of the collected data

The criterion for the duration of storage of personal data is the respective legal retention period. After the expiry of this period, the corresponding data is routinely deleted if it is no longer required for the fulfilment or initiation of the contract.

3.10 Routine deletion and blocking of personal data

The controller shall process and store personal data relating to the data subject only for the period of time necessary to achieve the purpose of storage or where provided for by the European legislator or other legislator in laws or regulations to which the controller is subject. If the purpose of storage ceases to apply or if a storage period prescribed by the European Directive and Regulation Giver or another competent legislator expires, the personal data will be blocked or deleted as a matter of routine and in accordance with the statutory provisions.

a)    Right to confirmation

Every data subject has the right, granted by the European Directive and Regulation, to obtain from the controller confirmation as to whether personal data relating to him or her are being processed. If a data subject wishes to exercise this right of confirmation, he or she may at any time contact our data protection officer or any other employee of the controller.

b)    Right to information

Any person affected by the processing of personal data has the right, granted by the European Directives and Regulations, to obtain at any time and free of charge from the data controller information on personal data relating to him/her and a copy thereof. Furthermore, the European Directive and Regulation maker has granted the data subject access to the following information:

  • the processing purposes
  • the categories of personal data processed
  • the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular to recipients in third countries or international organisations
  • if possible, the planned duration for which the personal data will be stored or, if this is not possible, the criteria for determining this duration
  • the existence of a right of rectification or erasure of personal data relating to him or her or of a restriction on processing by the controller or a right to object to such processing
  • the existence of a right of appeal to a supervisory authority
  • if the personal data are not collected from the data subject: All available information on the origin of the data
  • the existence of automated decision-making, including profiling, in accordance with Article 22(1) and (4) of the DPA and, at least in these cases, meaningful information on the logic involved and the scope and intended impact of such processing on the data subject

The data subject shall also have the right to obtain information as to whether personal data have been transferred to a third country or to an international organisation. If this is the case, the data subject shall also have the right to obtain information on the appropriate guarantees in connection with the transfer. If a data subject wishes to exercise this right of access, he or she may at any time contact our data protection officer or any other employee of the controller.

c)    Right of rectification

Any person affected by the processing of personal data has the right, granted by the European legislator, to request the rectification without delay of inaccurate personal data concerning him. Furthermore, the data subject shall have the right to obtain the completion of incomplete personal data, including by means of a supplementary declaration, having regard to the purposes of the processing. If a data subject wishes to exercise this right of rectification, he or she may at any time contact our Data Protection Officer or any other employee of the controller.

d)    Right of cancellation (right to be forgotten)

Any person affected by the processing of personal data has the right, granted by the European Directives and Regulations, to obtain from the controller the immediate erasure of personal data relating to him/her, if one of the following reasons applies and provided that the processing is not necessary:

  • The personal data has been collected or otherwise processed for purposes for which it is no longer necessary.
  • The data subject withdraws his or her consent on which the processing was based pursuant to Article 6(1)(a) DPA or Article 9(2)(a) DPA and there is no other legal basis for the processing.
  • The data subject lodges an objection to the processing pursuant to Article 21(1) of the DPA and there are no overriding legitimate reasons for processing, or the data subject lodges an objection to the processing pursuant to Article 21(2) of the DPA.
  • The personal data were processed unlawfully.
  • The deletion of personal data is necessary to comply with a legal obligation under Union law or the law of the Member States to which the controller is subject.
  • The personal data were collected in relation to information society services offered in accordance with Article 8(1) of the DS-GVO.

If any of the above reasons apply and a data subject wishes to request the deletion of personal data stored on the website, he or she may contact our data protection officer or another employee of the data controller at any time. The data protection officer of the website or another employee will ensure that the request for deletion is complied with immediately. If the personal data have been made public by the website and our company, as controller, is obliged to delete the personal data in accordance with Art. 17 Para. 1 of the DS-GVO, the website will take reasonable measures, including technical measures, taking into account the available technology and the implementation costs, to inform other data controllers who process the published personal data that the data subject has requested these other data controllers to delete all links to these personal data or copies or replications of these personal data, unless the processing is necessary. The data protection officer of the website or another employee will take the necessary steps in individual cases.

e)    Right to restrict processing

Any person affected by the processing of personal data has the right, granted by the European Directives and Regulations, to obtain from the controller the restriction of processing if one of the following conditions is met:

  • The accuracy of the personal data is contested by the data subject, for a period of time that allows the controller to verify the accuracy of the personal data.
  • The processing is unlawful, the data subject refuses to have the personal data deleted and instead requests that the use of the personal data be restricted.
  • The controller no longer needs the personal data for the purposes of the processing, but the data subject needs them for the purpose of asserting, exercising or defending legal claims.
  • The data subject has lodged an objection to the processing pursuant to Article 21 (1) of the DPA and it is not yet clear whether the legitimate reasons of the controller outweigh those of the data subject.

If one of the above conditions is met and a data subject wishes to request the restriction of personal data stored on the website, he or she may contact our data protection officer or another employee of the data controller at any time. The website’s data protection officer or another employee will arrange for the processing to be restricted.

f)     Right to data portability

Any person affected by the processing of personal data has the right, granted by the European Directive and Regulation Giver, to receive the personal data concerning him/her, which have been provided by the data subject to a controller, in a structured, common and machine-readable format. It also has the right to transfer these data to another controller without hindrance from the controller to whom the personal data have been made available, provided that the processing is based on the consent pursuant to Article 6(1)(a) DPA or Article 9(2)(a) DPA or on a contract pursuant to Article 6(1)(b) DPA and that the processing is carried out by means of automated procedures, unless the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller. Furthermore, in exercising their right to data transfer, the data subject has the right, in accordance with Article 20 paragraph 1 of the DPA, to obtain that personal data be transferred directly from one controller to another controller, insofar as this is technically feasible and provided that it does not adversely affect the rights and freedoms of other persons. In order to exercise the right to data transfer, the data subject may at any time contact the data protection officer appointed by the website or any other employee.

g)    Right of appeal

Every person concerned by the processing of personal data has the right, granted by the European legislator, to object at any time, for reasons arising from his or her particular situation, to the processing of personal data concerning him or her carried out pursuant to Article 6(1)(e) or (f) of the DPA. This also applies to profiling based on these provisions. In the event of an objection, the website will no longer process the personal data unless we can prove compelling reasons for processing that are worthy of protection and outweigh the interests, rights and freedoms of the data subject, or the processing serves to assert, exercise or defend legal claims. Where the website processes personal data for the purpose of direct marketing, the data subject shall have the right to object at any time to the processing of personal data for the purpose of such marketing. This also applies to profiling, insofar as it is associated with such direct mail. If the data subject objects to the website processing for direct marketing purposes, the website will no longer process the personal data for these purposes. In addition, the data subject has the right to object, on grounds relating to his or her particular situation, to the processing of personal data concerning him or her which is carried out on the website for purposes of scientific or historical research or for statistical purposes, in accordance with Article 89 (1) of the DPA, unless such processing is necessary for the performance of a task carried out in the public interest. The data subject shall also be free to exercise his right of objection in relation to the use of information society services, notwithstanding Directive 2002/58/EC, by means of automated procedures involving technical specifications.

h)    Automated case-by-case decisions including profiling

Every person concerned by the processing of personal data has the right, granted by the European legislator, not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him/her or significantly affects him/her in a similar way, provided that the decision (1) is not necessary for the conclusion or performance of a contract between the data subject and the controller, or (2) is authorised by Union or national legislation to which the controller is subject and such legislation provides for adequate measures to safeguard the rights and freedoms and legitimate interests of the data subject, or (3) is made with the explicit consent of the data subject. Where the decision is (1) necessary for the conclusion or performance of a contract between the data subject and the controller or (2) is made with the express consent of the data subject, the website shall take reasonable steps to safeguard the rights and freedoms and legitimate interests of the data subject, including at least the right to obtain the intervention of a person from the controller, to put forward his point of view and to challenge the decision. If the data subject wishes to exercise rights relating to automated decisions, he or she may at any time contact our Data Protection Officer or any other employee of the controller.

i)      Right to revoke a data protection consent

Every person affected by the processing of personal data has the right, granted by the European Directive and Regulation Giver, to revoke his or her consent to the processing of personal data at any time. If the data subject wishes to exercise his or her right to withdraw consent, he or she may at any time contact our data protection officer or another employee of the controller.
